Alternative dispute Resolution

Alternative Dispute Resolution (ADR) is a procedure that uses the services of a neutral to assist parties in reaching agreement and avoiding litigation. Types of ADR include mediation and arbitration.

There are real advantages to ADR, as it offers both parties the opportunity for a fast and informal settlement of the dispute without the expense, delay, and uncertainty associated with traditional litigation. Rather than leaving the decision to a third party, such as a Judge or Jury, ADR gives you the opportunity to reach a voluntary, consensual agreement that’s suitable to all parties involved.

TBSF’s Tim Born is a seasoned litigator, mediator, arbitrator and medical review panel chairman. Members of both the plaintiff and defense bars, including experienced mediators themselves, have nominated him to mediate their cases. In addition to personal injury cases, Mr. Born has experience mediating a wide range of disputes, including construction cases, real estate matters, employment disputes, medical malpractice, and a variety of commercial cases. Max Fiester has been a registered civil mediator since 2019. Using his 20 years of experience as a litigator that began when ADR was already a part of the practice of law, Max looks to focus on finding a solution with parties and believes that an agreement reached after all parties have had an opportunity to explore the strengths and weakness of their case is almost always the preferred outcome.
